Plaintiff, Frederick W. Hardin, filed suit in the Circuit Court of Etowah County against defendant, James G. Ryan, d/b/a Redlands Sports Center, and Kirby's Corporation, alleging that while bowling for Kirby's, he stepped into a hole in the floor of the alley and was injured. Plaintiff's complaint stated two counts. Count one was a simple negligence count against defendant Ryan. Count two was a count for breach of contract against Kirby's.
Defendant Kirby's Corporation moved to dismiss the suit against it, saying that the venue was improper as to it in Etowah County. The trial court granted Kirby's motion to dismiss. Kirby's Corporation did not appear at trial. The case against defendant Ryan was tried and a jury verdict was returned in plaintiff's favor for $2,000.00. Defendant Ryan moved for judgment notwithstanding the verdict or in the alternative, for a new trial. The trial court granted defendant Ryan's motion for judgment notwithstanding the verdict. Plaintiff appeals from this ruling. We affirm.
The sole question presented by this appeal is whether the trial court erred in granting defendant's motion for judgment notwithstanding the verdict. We answer in the negative.
